The Unified Register of Private Enforcement Agents of Ukraine is a general portal containing data on private enforcement agents from various regions and cities. The list includes individuals who have obtained a license, opened an office, and notified the Ministry of Justice in accordance with established legal procedures. It includes information about their activities and status (active or suspended/terminated).
Who is a private enforcement officer?
A private enforcement officer is a legal profession whose primary function is to enforce court decisions, just like that of a public official. Before seeking their services, it is essential to be aware of the restrictions imposed on private enforcement officers, as not all decisions are enforceable by them under the law. The main prohibitions on enforcement include:
- Removal and transfer of children, and removal of obstacles to meeting with children.
- Enforcement of obligations where the debtor is the state and its agencies, the National Bank of Ukraine, local government bodies, state-owned, and municipal enterprises.
- The debtor is a legal entity whose property may not be subject to forced sale under the law.
- Decisions in which the state or state bodies are the claimants.
- Decisions of administrative courts and decisions of the European Court of Human Rights.
- Decisions involving actions regarding state-owned or municipal property.
- Decisions regarding the eviction and relocation of individuals.
- Decisions in which the debtors are children or individuals who have been declared legally incompetent or whose legal capacity is limited.
- Decisions regarding the confiscation of property.
If the resolution of the case involves restrictions on private enforcement agents, it is better to immediately use the services of state enforcement agents—this is a legal requirement. Additionally, private enforcement agents are subject to a cap on the amounts they can collect during their first year of operation—no more than 20 million UAH.
Features of the Unified Register of Private Enforcement Agents
Under current legislation, Ukraine has established a mixed system for the enforcement of court decisions, which includes the institution of private enforcement agents. Information about private enforcement agents in the enforcement district and the contact details of their offices are posted in all courts and state enforcement service offices located within the relevant enforcement district.
A private enforcement agent notifies the Ministry of Justice of Ukraine of the commencement of their activities. A private enforcement agent has the right to commence activities from the date their information is entered into the Unified Register of Private Enforcement Agents of Ukraine.
Pursuant to Article 23 of the Law of Ukraine “On Bodies and Persons Carrying Out the Enforcement of Court Decisions and Decisions of Other Bodies,” access to the information in the Unified Register of Private Enforcement Officers of Ukraine is free of charge, available 24 hours a day and without restrictions on the official website of the Ministry of Justice of Ukraine, with the ability to search, viewing, copying, and printing information without the need for specially designed technological or software tools.

Payment for the contractor’s work
The payment principles for state and private enforcement agents differ. In the first case, wages are paid from the budget; in the second case, the situation is different. According to the law, private enforcement agents receive a base fee of 10% of the amount collected from the debtor—this constitutes their official income. In the case of enforcing a non-property-related decision, the fixed amount of the private enforcement agent’s basic remuneration is: 4 times the subsistence minimum for able-bodied individuals from a debtor who is a natural person and 8 times from a debtor who is a legal entity.
Private enforcement agents may enter into an agreement with the claimant regarding additional remuneration, in which the amount of remuneration and payment terms are specified in advance. However, this document is not required. In that case, no additional payments will be made. Enforcement agents must pay taxes on all income.
